Cross-border mediation training: the context

Previously there was negligible training in cross-border mediation, particularly outside the area of child abduction.  But in the past few years some training is now occurring, and the steering group has sought to embrace the primary players. 

A working group will consider how there can be any international consensus on necessary training to undertake international family mediation work.  There may be the following aspects amongst others:

  • How can the relatively advanced existing training in relation to child abduction work be extended to other aspects of international family disputes
  • What level of knowledge and experience is appropriate of the mediator before moving into training and work in international cases? 
  • Specifically what is the position of the specialist international lawyer then qualifying as a mediator?
  • What should be the component elements in a training programme for already qualified and experienced national mediators?
  • Who takes responsibility for the publishing of a list of those who have had any level of training?
  • Some countries require a period of mediation under supervision before mediator can practice alone.  How will this work when there is relatively little international mediation in practice?

This working group should also consider how much further it should go in other aspects or whether this should be another working group.  Many countries have a process of accreditation, a badge of some experience.  Is it too cumbersome to import and in any event who would accredit and under what authority and status?  These may be issues for consideration of the working party.

Having a list of accredited, recognised specialists after good quality training by experienced mediators and mediator trainers is a very early crucial element for the growth of an international family mediation profession.
